What is the role of the Office of the Federal Privacy Commissioner?
The Office of the Federal Privacy Commissioner is an independent Office which has privacy oversight responsibilities under the Privacy Act 1988 (Commonwealth) (this will take you to the Commonwealth of Australia Law website).
The Federal Privacy Commissioner provides information and advice relating to how your personal information is handled by:
- Federal and ACT Government agencies; and
- all large private sector organisations, all private sector health service providers and some small businesses.
This includes oversight responsibilities in relation to:
- Credit worthiness information held by credit reporting agencies and credit providers; and
- Personal tax file numbers used by individuals and organisations.
The Office of the Federal Privacy Commissioner also provides answers to frequently asked questions about privacy, including:
- your privacy rights;
- government;
- private companies;
- small business; and
- health.
The Federal Privacy Commissioner does not directly handle privacy matters that are covered by other privacy schemes or legislation in Australian states. However, the Federal Privacy Commissioner can assist you to determine who is best to speak to about your privacy concerns.

Does Queensland have a Privacy Commissioner?
No. The Department of Justice and Attorney-General, as lead
agency, provides information and support to Queensland Government agencies
implementing Queensland Privacy.
