Document—The Acts Interpretation Act 1954 defines ‘document’ as any paper or other material on which there is writing; and any paper or other material on which there are marks, figures, symbols or perforations having a meaning for a person qualified to interpret them; and any disc, tape or other article or any material from which sounds, images, writings or messages are capable of being produced or reproduced (with or without the aid of another article or device).

Fair means—An agency must not trick an individual into providing personal information or mislead an individual about the reasons why her/his information is being collected.

Generally available publication means a magazine, book, newspaper or other publication (however published) that is or will be generally available to members of the public.

Individual means a natural person.

Individual concerned, in relation to personal information or a record of personal information, means the individual to whom the information relates.

Information Privacy Principle means any of the Information Privacy Principles set out in Section 3 of Information Standard 42—Information Privacy.

Law enforcement agency means the Queensland Police Service, the Criminal Justice Commission, and the Queensland Crime and Misconduct Commission.

Lead agency means the Department of Justice and Attorney-General. Lead agency activities include providing best practice advice to agencies, training and development opportunities for agency Privacy Contact Officers, and working to ensure a high rate of compliance with IS42 across Queensland Government.

Personal Information for the purposes of all Information Privacy Principles other than Information Privacy Principles 6 and 7 means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion.

Personal Information for the purpose of Information Privacy Principles 6 and 7 is limited to information concerning an individual’s ‘personal affairs’ as the phrase ‘personal affairs’ has been interpreted in the Freedom of Information Act 1992.

Program: In relation to Privacy Impact Assessments, the term ‘program’ is understood to be synonymous with ‘project’, ‘scheme’, ‘application’, ‘initiative’, ‘system’, ‘strategy’, ‘plan’, ‘method’ and all other words indicating a defined course of action. ‘Program’ may also indicate a defined course of administrative action such as ‘policy’, ‘procedure’, ‘practice’, ‘process’ and the like.

Reasonable safeguards may be technical or operational in nature, and include clear roles, responsibilities, policies and procedures for handling of personal information.

Reasonable steps may involve direct contact with individuals for verification and/or clarification of information, updates to or deletions of information (where appropriate) and only collecting information that is relevant at the time, i.e. avoiding ‘just in case we need it later’ collections.
